The following are the Terms and Services of Breeosh's commission offers. They will explain you where to find commission offers, how to purchase them, the commission process in itself as well as delivery, refund, copyright and commercial use policies.APPLICABLE LAW AND JURISDICTION
These Terms of Service are governed by the laws of the Republic of Italy and applicable European Union regulations.OFFERS
I offer personalised commissions of your anthropomorphic or human-like original characters (OC) or fan requests, which will get labeled as such. Said characters have to be already pre-designed or drawn. I do not offer character designs at this moment.I work on industry standard canvases with 3000x4500px @ 300dpi for vertical and 4500x3000px @ 300dpi for horizontal layouts.I specialise on SFW and suggestive content, but do not offer NSFW yet. The exact spektrum of offers available are visible anytime on the active commissions info page.PURCHASE
My commissions can be purchased solely through Ko-Fi.
On my Ko-fi page the tab "commissions" shows all available offers, as well as their respective slot count and allocated prices.Extra-fees are shown in each commission listing. Commission prices will be paid upfront in full or, with a total worth of at least 200€, half upfront and half on finish.PROCESSING
The general processing stage is split into 3 parts: Sketching, Lineart, Colouring. Work-in-progress updates will occur after each stage is completed and after potential revisions have been applied. Each stage concludes with my update and will proceed to the next stage after receipt of confirmation by the client. Once the Colouring stage and it's potential revision are complete, the commission is finished and will be delivered immediately.All processing stages documentation and the final product will be watermarked by me and all manipulation or removal of such is prohibited.REVISIONS
One free revision per processing stage is included in the base price, regardless of the nature (big or small). Revisions cannot compromise an earlier processing stage, meaning a revision requested in the Lineart stage cannot impede immensely onto the sketching stage, changing fundamentals too late.If more revisions are requested, a fee of 1/4 of the base price will be charged per revision.Revisions that are requested because of a design mistake made by me, are free of charge and will be immediately addressed. This does not include my art style.DELIVERY
The delivery time may vary between one week to two months, depending on complexity. To receive your commission faster and "jump the line", a priority queue fee of 3/4 of the base price can be added. This has to be specifically stated by the client to take effect.Deliveries take effect upon finishing the piece through Ko-Fi.COMMUNICATION
If the client fails to respond to conversations, revisions or work in progress updates for a period longer than 14 days, the commission will be considered finished by both parties without need of refunds or further work. This also applies to time limited commissions.REFUNDS
Refunds can be requested through my contact details available on Ko-Fi, the direct chat or Social Media Channels. If the chargeback functions of paypal or stripe are being used to force a refund against my ToS or without contacting me prior, I reserve the right to refuse future commission work with said client.Commissions are fully refundable unless the processing phase has begun. If I'm unable to start your commission in a timely manner, I'll refund you the full price paid.In the processing stage, partial refunds are equivalent to the process stage the work is in, 1/3 of the total price refunded per unfinished stage. (Sketching completed = 2/3 refund for the client; Lineart completed = 1/3 refund for the client, etc).I do not offer refunds for finished artworks.RIGHT OF WITHDRAWAL (EU)
In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply to personalised digital content.
By purchasing a commission, the client expressly agrees that work on the commissioned artwork may begin immediately after purchase and acknowledges that they thereby waive their 14-day right of withdrawal once the processing of the commission has started.ILLUSTRATION RIGHTS
I retain copyright of your commission, and can display them in portfolios, on social media or as future commission samples. Illustrations will be branded with my watermark and either's manipulation/removal is prohibited. The design of the character or object itself stays with the original owner.The client is free to use their commission for personal use how they want.COMMERCIAL USE
Neither party can resell or commercially repurpose commissions made by me. If you wish to use it commercially, the full base price will be charged additionally to the total price. This includes: streaming, books, merchandising, videos and similar.COPYRIGHT INFRIGEMENT
I will take action against the following copyright infrigements:
- Commercial or profitable use without paying the additional fee.
- Denying or impersonating artist (e.g. pretending the art is yours)
- Editing or erasing my watermark
- Changing or editing the work without my consent
- Turning it into an nft
- Feeding my art into AICONTACT
